Ruling 2737 — Will (Waṣiyyah)

If the deceased’s estate exceeds the amount required to pay for his debts, his obligatory hajj, and his obligatory religious dues like khums, zakat, and maẓālim, then in the event that he has made a will that the one-third of his estate or part of the one-third of his estate must be spent for a particular purpose, his will must be executed accordingly. If he has not made a will, the remaining amount belongs to his heirs.
